Saint Katharine Drexel School is a catholic elementary and middle school located in Beaver Dam, WI. Their colors are royal blue, and their mascot is the cougar.

Merged in 1981 from 3 seperate schools, it was originally named Unified Catholic Parish Schools (UCPS). In 2002, it was renamed Saint Katharine Drexel School in honor of Saint Katherine Drexel, who was one of the first American born saints.

There are currently 22 teachers, plus support staff, and more than 250 students from preschool to 8th grade, at two campuses in town. It is also the only catholic middle school in the Archdiocese of Milwaukee with a full sized marching band.

Brian L. Ulery, a.k.a. Brian Ulery, was born in Elkins, WV on October 14, 1971. While receiving his undergraduate degree from the Pennsylvania State University, Mr. Ulery was a member of the President's Planning and Budgeting Committee. He continued this work while at the University of Pittsburgh, and also became the President of the Graduate and Professional Student Association during the 1996-1997 academic year.

After graduation, Mr. Ulery focused his career on the management of physician practices. Mr. Ulery is currently the Vice President of Physician Services for the North Broward Hospital District, the 5th largest public health system in the nation.

(1829 - 1893) (Translated from Mr Bhakta Darshan’s book on outstanding personalities of Garhwal – “Garhwal Ki Dewangat Vibhutian”)

1. “A nation which can produce men like Balbhadra Singh Negi, must have a Battalion of their own” (Ek jaati jo Balbhadra Singh Negi sarikhe purushon ko paida karti hai, use apni ek battalion awashya milni chahiye)

2. The words of India’s Jangi Laat Lord Roberts are attributed to that man who was born in 1829 in Pauri Garhwal, Patti Aswalsyun, village Haida Kholi. His father Dhan Singh was a common man. Balbhadra was the middle one of the three sons. He was barely 17 years old when his father expired. He was thus compelled to face the harsh realities of life by leaving his home.

3. Those days there was no battalion of Garhwalis. They had to enroll in the Gurkha Battalions. 5 Gorkha Battalion was located at Abbotabad in the NWFP. At that time railways were nonexistent. After many days of walking & facing several difficulties, he arrived at Abbotabad in 1847 & was enrolled. Progress in Military Career

4. He made speedy progress in the Army. It was a place & life far from his home. Those days there was a stigma on serving with the Gurkhas in the backdrop of the infamous “Gurkhyani” (the brutal atrocity ridden rule of the Gurkhas over Garhwal & Kumaon). In this environment it was not easy for a non-Gorkha to progress in his career. However Balbhadra served with enthusiasm & courage. He was a recruit, under training, for one year. After 13 months he became a Lance Naik. Shortly after he was a Havildar. During the 1857 mutiny he was a Havildar Major.

5. During the Afghan War he astonished all with his valor & intelligence. At that time the war veteran, Lord Roberts was appointed as Commander. The latter faced many difficulties initially. Afghans remained hidden in the rugged mountains. Whenever the British Army advanced, the Afghans surprised them by directing deadly volley of fire causing several casualties. No one knew which was the best & safest way to advance against the Afghans & which place was the most appropriate to concentrate maximum force to vanquish the enemy. The British High Command was deeply concerned about this.

6. Finally Balbhadra was summoned for this difficult task to surreptitiously find the secret to the Afghan tactics. He set out as a Pathan ascetic. (He was well versed with the local dialect- my comment from his manuscript biography). He lay amongst dead bodies for 7 days! Pathan warriors came & taking Balbhadra too to be dead, talked about their country, army, & military plans which the latter noted. At the end of 7 days he finally obtained the vital intelligence needed & safely made his way back to his camp. On the basis of this intelligence Lord Roberts made his plan & gained success. Lord Roberts remained forever enamored with Balbhadra’s intelligence & capability. On returning to England after retirement, he personally wrote about the aforementioned episode in his memoirs.

7. During the Afghan War, Balbhadra gave a befitting account of the valor of his kin. In 1879, in Afghanistan, his valor earned him the honor of “Order of Merit”. Next year near Kabul he again earned fame. The British Army was facing reverses in this vicinity. Despite this he took his Company into enemy lines, & after inflicting heavy casualties on them, returned to his camp safe & sound. In this encounter, an enemy bullet grazed his head thus wounding him. He was unaware of this till his colleague queried him about his blood stained uniform. Only then he was administered first aid. Next day he was again in the battlefield!

8. During the battle for Kandahar he was a Subedar. After the defensive battle for Kabul he was promoted to Subedar Major, the highest rank any Indian could aspire for. After this he was again decorated with “Order of Merit”. The C-in-C had proclaimed an award for “Sarvottam Sainik” (Outstanding Soldier?) which Balbhadra was honored with. Following this he was granted the “Order of British India” as a consequence of which he became “Sardar Bahadur”.

9. Later, Lord Roberts introduced a new appointment, i.e. Aide de Camp to the Jangi Laat (Lord Roberts), for Balbhadra which the latter held. Balbhadra was now referred to as “Laat Subedar”. This job entailed hardly any work. Yes, great respect & fame accompanied it. After five years as ADC, he proceeded on pension. For his immensely meritorious service he was gifted 1600 acres of land free of cost in village Ghosi Khatta of Kotdwara-Bhabhar. Raising Of Garhwal Regiment

10. When the Gurkhas were defeated in 1815, & Garhwal came under British rule, the inherent valor of Garhwalis was unknown to the world. The British had never contemplated raising a separate Regiment of the Garhwalis. After some time they raised a “khichri paltan” comprising of Gorkhas, Garhwalis & Kumaonis –“Nasiri Sirmoor Kumaon Battalion”. The same was later named Gorkha Rifles. Garhwalis could only enroll in its five battalions. Thus the number of Garhwalis was low, & it was very difficult to achieve career progression.

11. Balbhadra had himself experienced the slim chances to progress in the Gurkha battalions for any Garhwali. Thus he often pondered over the possibilities of a separate Garhwal Battalion so that Garhwalis could earn a name for themselves, apart from providing employment for several youth. Fortunately he found an opportunity to realize his cherished wishes.

12. Balbhadra’s valor & soldierly qualities had found a permanent place in Lord Robert’s heart. Finding an opportune moment, in 1880, the former expressed his desire to Lord Roberts and the latter assured him of sympathetic consideration.

13. Regarding this matter, Lord Roberts initiated correspondence with Viceroy Lord Dufferin, & in one meeting, uttered the historical & memorable sentence which has been quoted at the beginning of this chapter. While Balbhadra was ADC, he remained obsessed with his vision. His efforts continued even after retirement. Even the Viceroy was skeptical about a small place like Garhwal’s capability to provide men for a battalion. Then, Balbhadra gave the assurance that if a military cantonment was established within Garhwal, the requisite men can be provided. On this note, the proposal was accepted.

14. Eventually, in 1887, some Sardars & soldiers of the Gorkha Regiment laid the foundation of The Garhwal Rifles at Lansdowne, under the command of Major Mainwaring on 4 Nov 1887, after the name of Viceroy Lord Lansdowne. Since then it has grown into a beautiful cantonment.

15. The battalion that was raised as a consequence of his efforts earned a great name in the Indian Army. (Briefly I translate) 1889- Niti; 1891- 39 Garhwal Regiment; 1904 – Lhasa Tibet; 1922 – Malabar Moplah Rebellion & later RGR. 1914-18. -------- ( I World War) 1935-45. ---------- (lists awards & decorations) 1925--------------- (Raising of bns, Brahmins & later Shilpkars too enrolled. Opened avenues for the entire cross-section of society of Garhwal for employment) 1939--------------- (Peshawar episode, 1942-45 INA) Post Independence---- (J&K, NEFA, Indo Pak Wars, Bangla Desh etc)

16. His retired life was very peaceful. He kept company with saadhus/ saints & spent time in service to others, prayers, fasting & meditation. Despite his age he bathed daily with cold water, applied sandalwood paste & prayed. He never consumed liquor, nor smoked. He drank tea rarely; only when it was bitterly cold. He was a stickler for time. He is a role model for the current day soldiers who claim that they cannot survive without meat & liquor! A man of exceptionally strong character he was.

17. What can one say about this brave man? When the Garhwal paltan was being raised, his eldest son Amar Singh Negi was given the first direct Viceroy Commission into the Regiment. The uniform of a Jemadar & a sword was handed over to him at his home with orders to assume the rank at the Centre, Lansdowne! He is the same Amar Singh who sustained a bullet wound in the thigh in the Burma War. A telegram was received by his father Balbhadra Singh Negi, “Your son wounded by bullet in thigh”. Promptly this veteran soldier replied,” If of any service to the Government, keep him, else shoot him”. At the same time he telegraphed to his son, “Don’t worry. If you come out alive you will earn fame. If you die, you will still earn fame!”

18. One day, in 1893, near Gumkhal, in a place called Badru, he was in deep in meditation when a boulder fell on him. His thigh suffered serious injury. In this state he was evacuated to MH Lansdowne for treatment. During treatment, he peacefully passed away at the age of 64 years. The entire Garhwal paltan was in mourning. He was given a military funeral.

19. He left behind four sons – (a) Amar Singh, direct commission to Jamadar, attended King George V coronation ceremony at England as Sub Maj. He died on 4 Sep 1912 at Lansdowne at the age of 47. His eldest son Chandra Singh Negi rose to the rank of Capt in Garhwal Rifles. During 1942-45 he joined INA & as a Lt Col, was the Comdt of its Officers Training School. (b) Bhagwan Singh served for some years in the army, after which he spent his life as a landlord. (c) Shib Singh Negi also served for a short time in the army. He engaged in his private enterprise. He died in1942. His eldest son Gopal Singh was a successful businessman of Lansdowne & was a member as well as the Vice President of the Cantonment Board. (d) Girdhari Singh Negi retired as Sub Maj.

20. Thus, today, the clan of Balbhadra Singh Negi is leading a peaceful & prosperous life. But his extended family is the populace of Garhwal who have been, are & will be benefiting from the employment created by the mere creation of The Garhwal Rifles in 1887. Garhwal battalions & Lansdowne are indeed a fitting tribute to Balbhadra Singh Negi (whether the present generation acknowledges it or not).

I went to his estate at Kotdwar during March 1988, & met his grandchildren who were in possession of an exhaustive biography, as well as the following medals (These I tried to replicate with my pen in my diary which I still possess):- (a) OBI mark IIII. (b) Indian General Service Medal (1854-1895) - with.... Queen Regina embossed on Obverse side & an Angel blessing a man on the Reverse. Clasps of LUSHAI 1889 - 82, & BURMA 1889-92. (c) India Medal 1895-1902) Medal with embossed VICTORIA REGINA ET IMPRATRIX Clasps PUNJAB FRONTIER1897-98, & TIRAH 1897-98. (Same clasps were earned by Sgt David Mac Adie of the 72nd Duke of Albany’s Own Highlanders) (d) OBI 2nd Class with a maroon ribbon. (e) AFGHANISTAN MEDAL (elephant embossed) with Clasps PEIWAR KOTAL, CHARASIA, KABUL, KANDAHAR, with a ribbon light green on the sides & navy blue band in the centre. (f) Three more medals, belonging to Balbhadra? (i) Crown with GR & 22 June 1911 on reverse & Queen & King( Bearded) on Obverse. (ii) Brown maroon & green ribbon with a medal embossed with Persian? script embellished with leaves. (iii) DELHI DURBAR 1903, Edward VII

With the assistance rendered by friends in UK, I have been able to identify the above mentioned medals. However, I have been informed that Lord Roberts’ personal records are lying at Kew, enclosed in 48 boxes, last opened in 1859 by Countess Roberts in 1952 “The National Archives WO - Records created or inherited by the War Office, Armed Forces, JAG, & related bodies. Record Summary Title - War office. I am seeking the help of anyone who can access these boxes to corroborate Lord Roberts’ association with Balbhadra Singh Negi. I shall be indeed grateful.

ACTIVE CLEARANCE CONTROL- ACC

Active clearance control(ACC) is part used in the Modern gas turbine engines especially in turbo fan engines for the cooling of tuurbine blades. this increases the turbine blades operating temperature which in turn allows the raise of TIT (turbine inlet temperature)which is necessary for better engine efficiency.

the active clearance control in incorporated with ACC valve which receives the air from the by pass airflow and routes the air to flow over the pipes surrounding the turbine casing which inturn reduces the thermal expansion of the turbine case and maintaining the accurate clearance between the turbine case and the blade tip. this clearance should be maintained accurately which is essential for the engine efficiency and its performace. this ACC valve opening is adjusted automaticaly by the Fadec system in order with the throttle position.

IS1 Integral Scheme Airliner

IS1 is 150-182-passenger aircraft is being designed in partnership with MATI (Moscow Aviation and Technology Institute), SibNIA (windtunnell tests also being carried in TsAGI), UTAIR Airlines. Preliminary first flight date is 2015. It has Developed with Forward-Looking Aerodynamic Configuration

Development of the new IS-1 airplane with a forward-looking aerodynamic configuration is underway by a cooperative headed by OAO Russian Aviation Consortium Central Financial and Industrial Group Company, the Russian Aviation Consortium’s general director, Valentin Klimov, reported.

“The IS-1 airplane project has been developed in cooperation with the leading enterprises and scientific research institutes of the industry,” he noted.

V. Klimov specified that OAO Aviapribor Holding Company, OAO Aviadvigatel’, the Chaplygin Siberian Scientific Research Institute and the YuTehyr ((Yu. T. Air)) airline have been activated in the project.

In the specialist’s opinion, at the present time all the prerequisites for the creation of a highly effective new generation transport airplane exist. “Aircraft construction has made a major step forward recently: aircraft engines have appeared with a high degree of bypass ratio, a new elemental equipment base, including new composite materials. Right now there are two aircraft building high points – the Airbus A380 in passenger capacity and the Boeing 787 in engineering,” V. Klimov thinks.

According to him, the aerodynamic configuration selected for the IS-1 airplane provides an aerodynamic quality which occupies an intermediate position between today’s best factors and the potential factors of the flying wing type of airplanes. There tasks which have been placed before the developer are: incorporate an integral configuration, fully increase the airplane’s effectiveness, increase fuel effectiveness at a minimum to 14 – 16 grams per passenger kilometers and assure Russia’s priority in such an integral configuration.

The aerodynamic characteristics become apparent to the greatest extent at speeds on the order of Mach 0.85. “The airplane’s aerodynamic quality at such a cruising speed equals 10 instead of the 6 – 7 in modern airplanes,” V. Klimov emphasized.

“The proposed design’s weight ratio is approximately 40 percent higher than in an airplane of a conventional configuration. The IS-1 corresponds to the Tu-154 airplane with a weight of nearly 100 tonnes in passenger capacity, and the IS-1 has a weight of 61 – 64 tonnes. At the same time, the airframe’s weight is 31 tonnes,” he also noted.

According to the specialist’s data, different arrangements of the aircraft engines are possible – beneath the wing and on the fuselage. The avionics have been developed by OAO Aviapribor Holding Company – it is a fully digital aircraft for the resolution of all contemporary missions.

It is expected to make first flight in 2010 and start series production in 2011.

The mythical Jack Haggett was born in Penola of South Australia and apparently lives at Carn Court Holiday Apartments.

He has been said to have been a very strange child but who knows. Jack Haggett has many alias: Haggett, Jack, Wolfman (or in english 'very hairy man'), p00yhead etc.

Reports have been buzzing around about sitings of this creature "canoeing" in the Irymple Secondary College school dam (very bad canoeing), witnesses claimed that he kept yelling "dead beat" at other people who could not paddle "perfect" and when it came time for him to paddle he had no clue.

If anyone comes across this thing. they should consider him armed and dangerous, as he is a violent man who will give you nightmares with his hairy chest.

ZAKARYA

ZAKARYA is a French quartet founded in 1999.

In 2000, John ZORN, leader of New York's musical avant-garde, discovered the compositions of the unclassified accordionist and band's leader, Yves WEYH and proposed to produce their first CD on his prestigious label TZADIK. Only French band produced by John Zorn, ZAKARYA, released its first album in 2001. In the midst of Tzadik, their name comes close to others like Masada, Derek Bailey, Fred Frith, and Mike Patton...and the CD is available all over the world (USA, Europe, Japan...).

It seems to be a successful collaboration since two years later in 2003 Tzadik produced ZAKARYA's second album, "Something Obvious".

In august 2006, ZAKARYA releases its new album "413 A". A third CD produced by Tzadik with special guest Marc RIBOT, prestigious guitarist and fellow traveller to John Zorn, Tom Waits, Dave Douglas...

ZAKARYA happily loots the most various of musical styles. From rock, it takes the sound group. From contemporary musics, polyrhythms and un-tonality. From dance music, the direct and popular side. From jazz, the improvisation. From Klezmer or Balkan musics, their melodies. "Musiques concrètes" or electronic, cartoons, circuses, sound effects and minimalism are not forgotten. With all those elements, ZAKARYA makes a stimulating and surprisingly original music.

Here, folk arts are coming close to the avant-garde; the written and the improvised are walking hand in hand; jazz and rock exchange winks. The only rule is to play a personal, rigorous and exhilarating music. Compositions "à tiroir", hidden beats, musical puzzles, culinary recipes as scores, clichés. Each of us is invited to listen to the story in the story, to appreciate the wheeze or to unravel the scripts which are building this repetoire.

So, jazz or rock? improvised music? Klezmer music?

Danny Marshall

Danny is probably the most successful product of the Romford youth policy. He is always amongst the leading point scorers both at the club and in the league and has wonderful stick handling skills and great vision. He made his Raiders debut in 1993 and enjoyed a testimonial match after completing 10 seasons. He has topped the 100-point mark in the last 4 seasons and now holds every British scoring record at the club. In 2001 Danny was called up the GB squad for the tournament in the Ukraine where he gained more valuable experience. Danny returns to the club for his 14th season, hoping for another profitable season in front of net.

Appropriation of payments:

When a customer owing two or more debts to the banker pays money which is not sufficient to discharge all the debts, the question as to appropriation of payments arises. If the customer owes several debts to the banker and makes payments, he has the right to request the banker to apply the payment to the discharge of some particular debt. If the banker accepts the payments, he is bound by the appropriation as done by the customer. In absence of any such direction from the customer the banker has the right to use the payment at his discretion including the liquidation of a time barred debt. However, where neither the customer nor the banker makes an appropriation, such payment shall be applied in discharge of the debts in order of time they were incurred and the money received will be applied towards the repayment of the first debt. (Kamleshwari Pd. vs. Gangadhar).

With regard to a current account or a running account, if there has been no specific appropriation by the banker or the customer, it is held that receipts or income received would be utilized to reduce the first amount due. This was the decision arrived in the case of Devaynes vs. Noble and is known as Clayton’s rule. Let us assume Aditya’s account is overdrawn by Rs. 10,000. The account is credited by a cheque, received from a customer, of Rs. 2,500 and on the same day there is a cheque payment of Rs. 3,500. Based on this rule, the original overdrawn amount of Rs. 10,000 is reduced by Rs. 2,500 to reduce the original debt. Rs. 3,500 is a new debt. Then if there is another cheque received of Rs.2,000, the original debt of Rs. 10,000 (now Rs. 7,500) would be further reduced.

In this particular case Devaynes was the senior partner of a firm of bankers. When he died the other partners continued to carry on business under the same partnership of Devaynes, Dawes, Noble & Co. even though Devaynes’ son and the trustees of the late Mr. Devaynes’ estate stated that the usage of the name was without their consent. The firm went bankrupt the next year and the partners were insolvent. Nathaniel Clayton represented those who continued to deal with the partners after Devaynes’ death both by paying in and paying out. Some withdrawals were made after the death before amounts were paid in. The balance on the whole increased. With regard to Clayton, he had a balance of ₤ 1,713 at the time of Devaynes’ death. This reduced to ₤ 453 within a few days. Before the bankruptcy withdrawals amounted to considerably more than ₤ 1,713. Clayton claimed ₤ 453 from Devaynes’ estate arguing that subsequent withdrawals from the account were to be set off against later credits. Sir William Grant, the judge who ruled in this case stated, “….But this is the case of a banking account, where all the sums paid in, form one blended account, the parts of which have no longer any distinct existence. Neither banker nor customer ever thinks of saying this draft is to be placed in the account of ₤ 500 paid in on Monday, and this order of ₤500 paid in on Tuesday. There is a fund of ₤1,000 to draw upon, and that is enough. In such a case there is no room for any other appropriation than which arises from the order in which the receipts and payments take place, and are carried into the account. Presumably, it is the sum first paid in, that is first drawn out. It is the first item on the debit side of the account, that is discharged, or reduced, by the first item on the credit side......”

The rule in Clayton’s case affects all current accounts, whether overdrawn or not. As far as the banker is concerned he is only concerned about overdraft accounts to determine the liability of each party.

Applicability of Clayton’s Rule to Banking Transactions:

1. Death or Insolvency of a Partner or Joint Account Holder: In case of death of a partner, his estate is liable for the debts created before his death. If the overdraft or cash credit account of the firm is continued unbroken after the notice of death, all credits reduce the liability of the deceased’s estate, while fresh advances are the sole responsibility of the surviving partners by operation of the rule in Clayton’s rule.

2. Determination of a Guarantee: By giving a notice in writing to the bank a guarantor may revoke a continuing guarantee as to future transactions. It can also be determined by death or insolvency of the guarantor. In any such situation the borrower’s account should be broken or otherwise the Clayton’s rule will apply and all subsequent credits will reduce the liability of the guarantor, or his estate, while all payments out will constitute a new debt unsecured by the guarantee.

3. Notice of second charge: When the banker receives a notice of second charge over the customer’s properties, the account of such customer should be stopped to avoid the application of Claton’s rule. A new account should be opened for all future transactions. If such arrangements are not done then all subsequent amounts paid to the credit will reduce the amount secured by first mortgage/charge over the property. All withdrawals made after the notice will create fresh debts ranking after the right of the second morthgagee.

Garnishee Order:

A garnishee order is an order issued by a court, at the instance of the judgement creditor attaching funds in the hands of a third party who owed money to the judgement debtor. The procedure to be followed by the court to attach debts is provided in Rule 46 of Order XXI of the schedule to the Code of Civil Procedure. The court issues a written order prohibiting the creditor, i.e. the judgement debtor, from recovering the debt and the debtor from making payment thereof until further orders of the court. The debtor by whom the money is due is called garnishee. The order is issued when the the debtor fails to pay the debt owed by him to his creditor.

Let us suppose X has obtained judgement against ‘Y’ for Rs. 1,000 and Z owes Rs 2000 to Y. Z can be ordered by court to pay Rs. 1000 to X instead of to Y and such payment will be good discharge of Z to the extent of Rs. 1000 with regard to his liability to ‘Y’. In regard to credit balances, the banker is the debtor of his customer. An order may be served on the banker and such banker will take the position of Z. Such order attaches the balance in the account of the customer and on receipt, the banker’s obligation to honour the customers cheque is extinguished.

As soon as the banker receives a garnishee order in regard to a customer’s account, the balance in such account is attached and the banker’s right to honour the customer’s cheque is extinguished. The banker should inform the customer about the garnishee order so received.

Stages involved while serving garnishee order to the banker: • The Court will issue an order called ‘order nisi’ directing the banker to stop payments from the customer’s account explaining why the funds in the account should not be made to the bank’s customer (i.e. the judgement creditor) . If the garnishee (the banker) has any objection as to his liability towards the judgement debtor, he must appear in court showing cause why he should not pay. • After hearing the banker in response to the order nisi, the court would issue an ‘order absolute’ directing the bank to pay the entire or part of the balance of the customer account to the judgement creditor or to the court. Such payment legally discharges the bank but no such discharge is possible before the order nisi is made absolute.

A garnishee order is not applicable when: 1. The account is overdrawn. 2. The debt is not actually due to the customer; 3. The bank is entitled to set-off the balance against a debt due to it from the judgement debtor; 4. The banker is aware that the money in the account is held by customer in the position of a trustee; 5. The name or the description of the customer in the garnishee order is wrong or inaccurate. 6. The account is a joint account and the order is made in the single name of the customer .

Effects of Garnishee order:

1. Joint Accounts: If there is a joint account in the names of two or more persons, it cannot be attached by a garnishee order served on the bank quoting only one of them as judgement debtor. The garnishee order can attach money of the customer in his own right.

2. Partnership Accounts: A garnishee order in the name of the partners does not attach the firms account but a garnishee order in the name of firm attaches the firms account as well as the partners personal accounts too.

3. Proprietorship Accounts: If the customer is the sole proprietor of a firm, the firms account is attached by the order issued in the name of the sole proprietor only as a judgement debtor.

4. Executor/ Administrator/Trust Accounts: If the customer operates the account in a fudiciary capacity, the balance held in such account cannot be attached as the order so issued is in the personal name of the customer.

5. Accounts impressed with Trust: A account maintained by the customer on behalf of his client or under a trust cannot be used to settle personal liabilities and the banker is not bound by the garnishee order. He should make this fact known to the court that his customer holds the account as a trustee. The court after hearing any such representation of the customer and or the bank the court will decide.

Attachable debts: • For the order to attach, the debt should be due or accruing and the amount from the bank becomes due when the demand is raised. • Money has been debited to the accounts before the receipt of the garnishee order i.e. the transaction is completed before the service of the order. A mere book entry without communication to the beneficiary is revocable and such amount can be attached. • Cleared balance is only attached by the order if the items in course of collection are returned unpaid then they can be charged to the account. • Garnishing order can attach only moneys which belong to the customer in his own account. If the account is a joint account with either or both to sign, the court cannot attached the account in a joint name if the order so furnished is in a single persons name. • If the customer has validly assigned to the third party the amount of balance or any part part there off and the banker has received a notice of the assignment and the assignment so made is genuine, the garnishee order will not apply as the amount so assigned has ceased to be the property of the customer. • The banker would also be entitled to set off a debt due to itself at the time of the order nisi against the balance attached, provided the conditions in which a right of set off can be exercised.

HO CHI MINH CITY, Vietnam -- At least 50 people have been killed and more than 100 injured after a fire tore through a six-story building in Vietnam's Ho Chi Minh City that housed shops, a disco and several foreign companies.

Vietnamese officials say dozens more people may have been trapped in the Sai Gon International Trade Center complex, located in the city's busiest commercial district, an area which houses many hotels.

Officials said at least 54 people had been confirmed dead, including two British nationals, in the city's worst fire since 1975. But that figure is expected to rise, possibly to over 100, in the coming days.

State media said 120 people were injured in the fire which began at 1:15 p.m. local time (0615GMT) on Tuesday. Initial reports indicated it may have been sparked by a short-circuit in the Blue Disco -- one of the city's most popular dance spots -- on the building's second floor.

Intense heat and lingering flames prevented firefighters from entering the building for about four hours with firefighters taking more than five hours to extinguish the inferno.

Bodies were still being recovered from the site late Tuesday though it is unclear whether any foreigners were among the dead or injured.

It was reported that U.S. insurer American International Assurance was holding a training course for more than 100 staff at the time of the fire. There were also unconfirmed reports there was a wedding party in the building.

Barricaded On Wednesday, the building -- which contains several floors of shops, around 50 offices and the disco and has a usual occupancy of about 500 people -- was barricaded with police keeping onlookers at bay.

At least five fire fighting vehicles were at the site on Wednesday though none were in use, a far cry from the scene on Tuesday when 30 fire engines and 40 ambulances surrounded the building. The VNA reported that firefighters were not fully equipped to fight the fire and lacked water to put out the flames.

Power in the area was cut off and streets cordoned off.

Flames raged at other windows sending dense black smoke into the sky as workers fled for their lives, many down steel ladders reaching up from fire trucks below. Others jumped out of the windows.

Ho Chi Minh City, formerly named Saigon, is Vietnam's southern commercial center.

The building was insured since 1997, Reuters news service reported, with the total value of the contract at 12.3 billion dong ($800,000).

Todd McCormick

Todd McCormick is a noted medical marijuana activist. After Proposition 215 was passed in California, McCormick was involved with others, including Peter McWilliams, in growing marijuana for themselves and others.

Todd suffered from a childhood disease known as Histiocytosis X. At the time, the disease was considered to be a cancer and was treated very aggressively. The tumors which characterize the disease are now known to be benign. Regardless of our knowledge today that the tumors are benign, the side effects Todd McCormick suffered from the treatment for the disease were detrimental to his health. The disease recurred in McCormick nine times before he turned 10, beginning at the age of 2. He was treated aggressively, with chemotherapy, surgery, and radiation. This treatment resulted in many medical problems for McCormick. For example, his hips stopped growing because of the treatment, and remain the size of a child of 8 years. One specialist who saw McCormick's X-Rays is said to have been surprised that McCormick was not wheelchair-bound. Also, the top-five vertebra of McCormick's spine have been surgically fused together. McCormick points out the irony that his health problems are almost exclusively the result of the treatment of his disease, not the disease itself, and that the treatment is now acknowledged to be unnecessary for people with Hystiocytosis X. The far reaching effects of nearly 10 rounds of aggressive cancer treatment in childhood have given Todd several serious health issues which McCormick medicates with cannabis. Thus, McCormick's use of medical marijuana is not because he has cancer, but because of the conditions he suffers from as a result of the unnecessary but vigorous and repeated cancer treatment he received in childhood.

McCormick first found relief in marijuana when he was 9 years old. Todd had been given less than a year to live, and, desperate, McCormick's mother showed an article she had read in Good Housekeeping about the use of medical marijuana to Todd's doctor. The doctor approved of the treatment. McCormick's mother helped him smoke the marijuana. On an episode of "Politically Incorrect with Bill Maher", Todd described its effects, saying, "It was amazing. Actually, I was nine years old. I had cancer in soft tissue between my left lung and my heart. I was given six months to live. As a last-ditch effort, my mother gave me some marijuana...Medical marijuana gave me a regained appetite. It gave me a better mental clarity. It made me feel better. It improved the way I felt about life."

After Proposition 215 was passed in California, Todd McCormick began growing medical marijuana for himself and others. The home in which he was growing the marijuana was raided. McCormick was the first person to be arrested by the Federal government for a medical marijuana related offense after California passed Proposition 215, which legalized the use and growing of medical marijuana for those who benefit from the medicine and their caretakers. Eventually, Todd McCormick served several years in federal prison. He was released in 2003.

If they show up on Bill Maher's Politically Incorrect, you should be able to read about them on Wikipedia. You guys need to get it together.

A story from Nevers, which is reproduced in the Golden Legend, states that one night the Emperor Charlemagne dreamed that he was saved from being killed by a wild boar during a hunt by the appearance of a child, who had promised to save the emperor from death if he would give him clothes to cover his nakedness. The bishop of Nevers interpreted this dream to mean that he wanted the emperor to repair the roof of the cathedral dedicated to the boy-saint Saint Cyricus.

ICONOCLAST: Avant Jazz/Punk Duo from NYC Since 1987

ICONOCLAST is a duo from New York City comprised of Julie Joslyn (alto saxophone, live electronics, violin, vocals) and Leo Ciesa (drums, percussion, keyboards, vocals). Ciesa and Joslyn have been composing and performing together since the beginning of 1987 and have developed an eclectic body of material. ICONOCLAST's music and performance is known for its distinctive sound and for its intensity, physicality and "larger than duo" impact. Acoustic and electronic sounds exist side by side as the music moves between improvisation and composition.

ICONOCLAST is recognized worldwide for its pioneering approach to the duo and for its innovative instrumentation and composition. In some compositons the drums take the role of stating the melodic theme. In some, the violin is the main percussive force propelling the rhythm forward and at other times it sounds like a crunching electric guitar. The saxophone might play alternating bass and melody lines, sometimes interspersed with screams or percussive sound effects. Often compositional ideas will require one musician to play several instruments simultaneously or to play several lines or voices in alternating or rapid sucession, thus giving the illusion of more players.

ICONOCLAST plays regularly in New York City and also frequently performs throughout the United States, Canada and Europe. Ciesa and Joslyn have performed at various festivals, including the Avantgarde Jazz Festival in Imola, Italy; Audio Art Festival in Krakow, Poland; II Festiwal Muzyka z Mozgu in Bydgoszcz, Poland; Sziget Festival in Budapest, Hungary; International Ring Ring Festival in Belgrade, Serbia; Interzone International Festival in Novi Sad, Serbia; The Festival of Women Improvisers and NYU Independent Music Fest, in New York City. ICONOCLAST has been featured on various radio and television programs worldwide. Joslyn and Ciesa have done numerous radio and television interviews as well as a live on-the-air concert on WFMU-FM. ICONOCLAST composed and performed the title theme music for the cable television series "Labor at the Crossroads," and has been featured on the TV series "Welcome to Nocturnia (The Art World)." The duo composed and performed the music for the documentary film "Savage Acts: Wars, Fairs and Empire" and the website “The Lost Museum”(American Social History Productions, Inc.). ICONOCLAST contributed compositions to the compilation CD "Transforms: The Nerve Events Project" (Cuneiform Records). The duo has collaborated and performed with noted Polish poet Andrzej Dorobek. Ciesa and Joslyn have received grants from Meet the Composer and from Arts International: The Fund for U.S. Artists at International Festivals and Exhibitions and are recipients of Artist's Fellowships in Music Composition from the New York Foundation for the Arts.

He was based in L.A and Baltimore before moving to New York City in 1986. Leo Ciesa is also the drummer in the septet Doctor Nerve and can be heard on their recordings "Did Sprinting Die?," "Beta 14 ok," "Skin," “Every Screaming Ear,” and “Ereia” (Cuneiform Records) and on "Live at the Knitting Factory, Vol. 3" (A&M Records). He is also on Micro-East Collective’s CD “Out of My Face” (Umbrella) and Larry Polansky’s “Change” (Artifact). Leo Ciesa has an endorsement with Pro-Mark drum sticks.

JULIE JOSLYN (Alto saxophone, live electronics, violin, vocals) is a native New Yorker. She studied for a number of years with soprano saxophonist and composer Jane Ira Bloom. She has played with the Indian-influenced rock quintet Church of Betty, and can be heard on MacLean and Ponomarenko's album "Music Without Computers" and as guest screamer on Doctor Nerve's "Skin." In addition, she is a practicing psychoanalyst and painter.

Tommy Jammer

Tommy Jammer is a retired American professional wrestler who competed in Midwest regional promotions including Pro Wrestling America and the American Wrestling Association in the late 1980s.

Trained by Eddie Sharkey during the mid-1980s, he was one of several wrestlers as part of a talent exchange agreement between Sharkey and AWA promoter Greg Gagne to make his debut in the last years of the AWA. [7] Participating in a 17-man Battle Royal to crown a new AWA World Heavyweight Champion in St. Paul, Minnesota on February 7, 1989 [8], Jammer was the first man to be eliminated. [9]

He did, however, score one of his first victories in the promotion defeating Mike Enos almost two weeks later in Marshfield, Wisconsin on February 18 and, in a tag team match with Derrick Dukes, defeated Badd Company resulting in Pat Tanaka and Paul Diamond splitting up in Rochester, Minnesota on May 6, 1989. [10]

Feuding with Jonnie Stewart during his early months in the promotion, he defeated Stewart at AWA War in the Windy City on June 23 [11] and later appeared on several supercards during the next year loosing to Tully Blanchard at SuperClash 4 on April 8 [12] and wrestled in numerous matches as part of Baron von Raschke's Baron's Blitzers during the Team Challenge Series, eventually facing Larry's Legends (Destruction Crew & The Texas Hangmen) in an 8-man "Behind the 8-Ball" tag team elimination match on September 10, 1990. He would also feud with AWA World Heavyweight Champion Larry Zbyszko before he left the promotion in December 1990. Jammer would wrestle his last match with the AWA in Bloomington, Minnesota loosing to Larry Cameron on May 3, 1991.

Like many other AWA wrestlers, Jammer began to wrestle with the Minneapolis-based Pro Wrestling America after the AWA folded in 1990. He continued to wrestle in the Minnesota area during the early 1990s, winning the NSW Tag team titles with Baron von Raschke, although he would eventually retire by the end of 1994.

Free flow power refers to the generation of electricity from moving water without requiring the construction of dams or impoundments. Traditional hydroelectric generation uses dams (also referred to as "impoundments") to create a gradient (also know as "head") that increases the pressure of the water flowing through a turbine. ColdBox is a proven MVC event-driven CFC based ColdFusion Framework, specifically designed for high availability web applications. ColdBox provides a set of reusable code and tools that can be used to increase productivity, and it provides a standard that comes in very handy when working in a team environment. The purpose behind ColdBox was to create a fast & stable development methodology that could be shared among several developers. Emily D. Hodge

Emily Hodge was born on September 3'd, 1971, and is a frequent contributor to the forums at infidels.org. An outspoken communist and technocrat, Emily Hodge openly opposes Democracy as "Mob Rule." Emily wrote an opinion piece for the kiosk section of infidels.org called "God, Guns, and Gays" in which she outlined perceived inherent flaws in Democracy as a system of government. Among cited flaws is the suggestion that the general public are not sufficiently educated, nor sufficiently objective to act in the best interest of their community or country.

Currently Emily Hodge is working on a yet to be titled book, in which she plans to outline a brief history of the various governments of the world, and why (in her view) they have all been failures. Though a member of the Communist Party Emily Hodge openly opposes many communist governments, suggesting that they are the "anti-thesis of actual communism" and that the idea of communism has been corrupted by "despots and dictators" who have been "anything but communist."

Invisible Man (band)

Invisible Man is an eclectic alternative bamd based in Montreal, Quebec, Canada. Originally a solo act, Chaz Coats-Butcher formerly of The Forgotten Rebels, The Outpatience ( West Arkeen ) and Blah Blah Blah began writing songs for this project back in 2001. Chaz was introduced to drummer / producer Dan Legault in 2005. The two pooled there collective talents and resources to produce ' Music For Lost Souls and Misfits ' the bands debut CD.

After finishing the recording the next logical step was to put together a band so with the addition of Tim Alleyne on keyboards, Joe Sauro on the bass and Meo Guindon on guitar Invisible Man was born.

Luther Biggs is an American professional wrestler, also known by his ring name Disgraceland, who has competed in North American independent promotions including the United States Wrestling Association, Total Nonstop Action Wrestling and had a short stint in World Championship Wrestling during the late 1990s, most notably as one half of the tag team Hard Knox with Killer Kyle and manager Coach Buzz Stern.

Early career

During the mid 1990s, Biggs competed in the Memphis-based United States Wrestling Association as part of the stable the Country Boys along with Billy Joe Travis and Doomsday.

Although he had appeared in WCW several years before as "Big Sexy" Luther Biggs loosing a match to Ice Train on WCW Saturday Night on December 14 and WCW Pro on December 29, 1996 [1], he was later introduced by wrestler turned manager Coach Buzz Stern (who had previously wrestled as Glacier) as his new "protege" during WCW Thunder selecting him as part of his "Winners Club" on September 2, 1999. [2]

After appearing in subsequent vignettes as a somewhat clumsy varsity wrestler training with Stern [3], he made his debut on WCW Thunder loosing to Bobby Eaton on September 30. After loosing to Eaton, Stern attacked Eaton applying a full nelson hold on Eaton and then applying the hold on Biggs. [4]

Regularly appearing on WCW Thunder and WCW Worldwide, while he continued to lose to mid-card wrestlers such as Meng [5], he also had some success while on WCW Worldwide and WCW Saturday Night against the Blacktop Bully on October 23 although his victory was due only to his manager's interference. [6]

His last appearance in the promotion was with the New Harlem Heat as he stood at ringside with 4x4 during their match with Billy Kidman and his mystery partner Booker T on WCW Monday Night Nitro on March 6, 2000. [7]

Return to the Indys

In 2001, he appeared in NWA Wildside defeating his old manager Coach Buzz Stern on March 17 and, the following night, was at ringside with "Big" Ron Studd in a handicap match against Damien Steele and The Underdoggs and later defeated Romeo Bliss during the event. He also began wrestling for Dusty Rhodes Florida-based Turnbuckle Championship Wrestling [8] as "Lethal" Luther Biggs loosing to Bobby Hayes and, later that night, appeared in a tag team match with Larry Zbyszko against Dusty Rhodes and New Jack in Carrollton, Georgia on June 30.

Defeating Sean Evans in Woodstock, Georgia on December 7, he would later loose to Jorge Estrada on December 28. he later defeated Steve Madison on December 29 and Jason Sugarman on January 26, 2002.

Total Nonstop Action Wrestling

In 2003, Biggs resurfaced in NWA: Total Nonstop Action as Disgraceland [9] who was introduced by Glen Gilberti as the newest member of the stable S.E.X. after his debut defeating Shark Boy in Nashville, Tennessee on February 23, 2003. Following the match, Jorge Estrada of The Flying Elvises confronted Biggs over his Elvis impersonator gimmick and was attacked by Biggs, Gilberti and Mike Samples who later dragged Estrada backstage to the S.E.X. dressing room and flushed his head in a toilet. [10] Two weeks later, he would loose to Estrada after Gilberti and Sanders left ringside on March 5, 2003. [11]

He also teamed with Ron Reis to defeat Gilligan & Scotty Beach at the Rock N' Shock Benefit Show on September 16, 2006. [12] He also appeared with Lloyd and other celebrities such as musician Mark Wills and comedian Wix Wichman at the Steve Azar St. Cecilia Foundation Benefit Concert in 2007. [13]
