Fair use for Hammam

Though this image is subject to copyright, I feel its use is covered by the U.S. fair use laws because:

  1. Its inclusion in the article adds significantly to the article because it enables a direct comparison to be made with Ingres's similarly named painting of which Sleigh's picture is a gender reversal.
  2. Its inclusion in the article adds significantly to the article because it clearly demonstrates the orientalism of Ingres's view of the hammam.
  3. It is a significant painting for the proper understanding of how the subject of the article can be artistically depicted without the implication that it depicts a scene in a harem.
  4. It is of low resolution (copies made from it will be of very inferior quality).
  5. The photo is only being used for informational purposes.
