It is believed that this low-resolution version depicting a unique historic event — the final run of B&O's famous Royal Blue train — is permissible Fair Use solely for the Wikipedia article about the Royal Blue because:

1. it portrays a historically significant event, i.e., the end of all rail passenger service on a line started in the 1890s;
2. as a greatly reduced, low-resolution version, this image is non-reproducible for commercial purposes.
