The following rationale applies only to the use of this image in the article The Oxford Companion to Music. Although the picture is subject to copyright, I (Bluewave) believe it is covered by the U.S. fair use laws because:

1. a free alternative is not available;
2. it is a low resolution copy of a book cover;
3. it is only used in an article describing the book;
4. it does not limit the copyright owner's rights to sell the book in any way;
5. its low resolution means that copies could not be used to make illegal copies of the artwork;
6. its use is commensurate with usage in biographies and book listings across the World Wide Web.
