Rationale of fair use for Stalking Pete Doherty

The image is being linked here; though the picture is originally copyright, I (TreveX^talk 03:33, 13 December 2005 (UTC)) feel it is covered by fair use because:

1. The image is important to the article, providing an image of Max Carlish.
2. The photo is a still at a lower resolution than the original film.
3. As a still from a film, the photo is insignificant in relation to the size of the overall work and is therefore unlikely to affect the value of the original work in any way.
4. There are no known free or public domain photographs of Carlish.
5. This image does not limit the copyright owners' rights to distribute the original image in any way.
