Rationale of fair use for Nefarius

The image Image:Cap 170.gif is being linked here; though the picture is originally copyright, I (Lajbi Holla @ meWho's the boss? 12:02, 4 June 2006 (UTC)) feel it is covered by fair use because:

  1. The image is a cover for the comics "Captain America" created by Marvel Comics, and intended for wide distribution.
  2. The cover is of lower resolution and quality than the original comics (copies made from it will be of inferior quality).
  3. No free or public domain images have been located for this comics.
  4. The cover does not limit the copyright owners' rights to distribute the comics or in any way.
  5. The cover is intended to represent the "Captain America" comics and its character Nefarius.
  6. The cover is being used for informational purposes only, and its use is not believed to detract from the original comics in any way.
