The author asserts that the image qualifies fair use for the following reasons:
- Rockstar North and Rockstar Games have not release game screenshots into public domain.
- The image is necessary to describe the appearance the game's gameplay and graphics; nothing else.
- The screenshot is not intended to hinder the copyright owner's ability to sell the game.
- This image is a screenshot and thus immediately falls in fair use.
Non-free use in Grand Theft Auto clone
The use of this image is covered by the U.S. fair use laws because:
- Rockstar Games has released no such images into the public domain, and a replacement image could not be created that would adequately provide the same information.
