Rationale of fair use for No Limit Top Dogg

The image Image:Snoop front.JPG is being linked here; though the picture is originally copyright, I (Lajbi Holla @ meWho's the boss?) feel it is covered by fair use because:

  1. The image is a cover for the album No Limit Top Dogg created by No Limit Records, and intended for wide distribution.
  2. The cover is of lower resolution and quality than the original CD (copies made from it will be of inferior quality).
  3. No free or public domain images have been located for this album.
  4. The cover does not limit the copyright owners' rights to distribute the album in any way.
  5. The cover is intended to represent the No Limit Top Dogg album.
